Terms and Conditions of Use

These Terms and Conditions explain the rules for using the MySelf Healthcare app, website, platform and related services, together referred to as the “App” or “Service”.

By creating an account, accessing or using the App, you agree to these Terms. If you do not agree, you must not use the App.


1. About MySelf Healthcare

MySelf Healthcare is a digital healthcare support app designed for adult userswho are supporting a child under their care.

The App provides access to speech and language therapy information, advice, activities, resources, reminders, progress tools and related content. This content may be specific to a child and may be based on recommendations made by a qualified speech and language therapist.

The App is intended to help adults complete recommended speech and language therapy activities with a child between therapy sessions, appointments or episodes of care.

The App does not replace direct clinical care, diagnosis, therapy, safeguarding advice, emergency support or professional judgement.


2. Adult Users Only

The App is for use by adults aged 18 or over.

Children must not create accounts or use the App independently.

Where the App contains information about a child, that child is not considered the account holder or direct user of the App. The adult account holder is responsible for accessing and using the App appropriately and in the child’s best interests.

By using the App, you confirm that:

  • you are aged 18 or over; 
  • you are the child’s parent, carer, legal guardian or another adult with appropriate      responsibility or permission to support the child; 
  • you have authority to receive, access and use information relating to the child; 
  • you will use the App only to support the child’s care, communication, speech and language development or therapy plan. 

3. Information About the Child

The App may contain or collect information about a child, including information relating to their speech, language, communication, development, therapy goals, activities, progress and support needs.

You agree that any information you provide about a child will be accurate to the best of your knowledge.

You must not upload, enter or share information about a child unless you have the right or permission to do so.

Where more than one person has parental responsibility or caring responsibility for a child, you are responsible for ensuring that your use of the App is appropriate and lawful.

Children’s personal data receives specific protection under UK data protection law, and organisations must consider child-specific safeguards when processing children’s information. The ICO states that children merit specific protection in relation to their personal data, and that a lawful basis is required when processing children’s information. 


4. Role of the Speech and Language Therapist

The App may include speech and language therapy activities, advice or resources recommended by a qualified speech and language therapist.

You understand that:

  • therapy activities      should be completed as advised; 
  • you should follow any      instructions, cautions or limits provided by the speech and language      therapist; 
  • you should stop an      activity if the child becomes distressed, unwell, unsafe or unable to      participate; 
  • you should contact the      relevant therapist or service if you are unsure how to complete an      activity; 
  • the App does not      guarantee a particular developmental, communication or therapy outcome. 

The therapist, service or organisation responsible for the child’s care remains responsible for clinical decisions, recommendations and professional judgement.


5. Healthcare Disclaimer

The App provides digital support and information. It does not provide emergency medical care, urgent advice or crisis support.

The App is not a substitute for:

  • direct speech and      language therapy; 
  • medical assessment; 
  • diagnosis; 
  • emergency services; 
  • safeguarding services; 
  • mental health crisis      support; 
  • advice from a qualified      healthcare professional. 

You should not ignore professional advice or delay seeking help because of something in the App.

If a child or another person is at immediate risk of harm, call 999. For urgent but non-emergency medical advice in the UK, contact NHS 111.


6. Safeguarding

The App is not a safeguarding reporting service and may not be monitored continuously.

If you believe a child is at risk of abuse, neglect, exploitation, serious harm or immediate danger, you must contact the appropriate safeguarding service, local authority, healthcare provider, school, police or emergency service.

Where we become aware of information suggesting a serious risk of harm, we may take appropriate action. This may include contacting emergency services, safeguarding leads, healthcare providers, local authorities or other relevant organisations where lawful and necessary.


7. Your Account

You may need to create an account to use the App.

You agree to:

  • provide accurate and      up-to-date information; 
  • keep your login details      secure; 
  • not share your account      with anyone; 
  • tell us promptly if you      believe your account has been accessed without permission; 
  • use the App only for      lawful, appropriate and intended purposes. 

You are responsible for activity on your account unless the activity was caused by our failure to take reasonable security measures.

We may suspend or close your account if we reasonably believe that you have breached these Terms, misused the App, created a risk to a child or another person, or provided false or misleading information.


8. Appropriate Use of Therapy Activities

You agree to use therapy activities, resources and advice in a safe and appropriate way.

You must:

  • supervise the child      appropriately during activities; 
  • choose a safe      environment for activities; 
  • follow any guidance      given by the speech and language therapist; 
  • use activities only for      the child for whom they were recommended; 
  • avoid forcing the child      to complete an activity if they are distressed or unwilling; 
  • contact the relevant      therapist or service if you have concerns. 

You must not use App content to provide therapy, advice or support to another child unless that content has been recommended for that child by an appropriate professional.


9. Progress Tracking and App Outputs

The App may allow you to record activity completion, comments, observations, progress, concerns or other updates.

Any progress tracking, summaries, reminders or App-generated outputs are provided for support only. They do not guarantee:

  • improvement in speech,      language or communication; 
  • achievement of therapy      goals; 
  • diagnosis or discharge;      
  • access to services; 
  • reduction in waiting      times; 
  • a specific clinical      outcome. 

Any App outputs should be interpreted by an appropriate adult, therapist or service and should not be relied on in isolation.


10. Privacy and Personal Data

Our use of personal data is explained in our separate Privacy Policy.

The App may process personal data about adult users and children, including health-related information. We will process personal data in accordance with applicable UK data protection laws, including the UK GDPR and Data Protection Act 2018.

You are responsible for ensuring that any information you provide through the App is accurate and that you have the authority to provide it.

Where the App is used in connection with NHS or social care services, digital health technologies are commonly assessed across areas including clinical safety, data protection, technical security, interoperability, usability and accessibility under NHS England’s DTAC framework. 


11. Medical Device Status

The MySelf Healthcare App is not classed as a medical device.

The App is intended to support adult users to access information, advice, resources, reminders and speech and language therapy activities that have been recommended by a qualified speech and language therapist for a child under their care.

The App does not independently diagnose, prevent, monitor, predict, treat or manage a medical condition. It does not make clinical decisions, replace professional judgement, or provide automated diagnosis or treatment recommendations.

Any therapy activities, advice or resources provided through the App should be used only as directed by the relevant speech and language therapist or healthcare professional.

If you are unsure whether an activity is suitable for the child, or if the child becomes distressed, unwell or unable to participate, you should stop the activity and contact the relevant therapist, healthcare provider or service for advice.

We may update the App’s features over time. If the intended purpose or functionality of the App changes in a way that affects its regulatory status, we will review this and update these Terms where appropriate.


12. User Content

You may be able to upload, submit or record information, including notes, comments, activity updates, images, videos, audio, questionnaire responses or other content.

You retain ownership of the content you submit, but you give us permission to use it as necessary to provide, secure, improve and administer the App, in line with our Privacy Policy and any applicable agreement with you or your organisation.

You confirm that:

  • your content is      accurate to the best of your knowledge; 
  • you have permission to      provide it; 
  • it does not infringe      anyone else’s rights; 
  • it does not contain      unlawful, harmful, abusive or inappropriate material. 

We may remove or restrict access to content where we reasonably believe it breaches these Terms, creates a risk or may be unlawful.


13. Acceptable Use

You must not:

  • use the App unlawfully;      
  • allow a child to access      your account unsupervised; 
  • share your account with      others; 
  • upload false,      misleading, abusive, discriminatory, offensive or harmful content; 
  • use the App to harass,      threaten, exploit or harm anyone; 
  • attempt to access      another person’s account; 
  • interfere with the      security or operation of the App; 
  • copy, scrape, reverse      engineer or misuse the App; 
  • upload viruses, malware      or harmful code; 
  • use therapy materials      for children for whom they were not recommended; 
  • use the App as a      substitute for emergency, safeguarding or clinical advice. 


14. Availability of the App

We aim to make the App available and reliable, but we do not guarantee that it will always be uninterrupted, error-free, secure or available at all times.

We may update, suspend, restrict, replace or remove parts of the App for reasons including maintenance, security, clinical safety, legal compliance, technical improvements or service changes.

We are not responsible for delays, interruptions or data loss caused by events outside our reasonable control.


15. Third-Party Services and Links

The App may contain links to third-party websites, resources, videos, documents, platforms or services.

We are not responsible for third-party services unless we expressly state otherwise. Third-party services may have their own terms, privacy policies and rules.


16. Fees and Access

Some users may access the App through a healthcare provider, therapist, NHS service, local authority, school, employer, charity, insurer or other organisation.

Some features may be free and others may be paid for by you or by an organisation.

Where fees apply, payment terms will be provided separately.

Access to the App may end if your therapy episode, service involvement, contract or subscription ends.


17. Intellectual Property

The App, including its software, design, text, graphics, logos, resources, therapy materials, templates, workflows, videos and other content, is owned by or licensed to MySelf Healthcare.

You may use the App only as permitted by these Terms.

You must not copy, reproduce, adapt, distribute, sell, license, publish or exploit any part of the App unless we give written permission or the law allows it.


18. Feedback

If you provide feedback, ideas or suggestions, we may use them to improve the App without owing you payment or compensation.

We will not knowingly publish personal, child-related or confidential information from feedback without permission, unless legally required or appropriately anonymised.


19. Suspension and Termination

We may suspend or terminate your access to the App if:

  • you breach these Terms;      
  • you misuse the App; 
  • we reasonably believe your use creates a risk to a child or another person; 
  • your service, therapy      episode, contract or organisation’s access ends; 
  • we are required to do      so by law; 
  • the App or relevant      feature is withdrawn. 

You may stop using the App at any time. You may request account closure by contacting us at support@myselfhealthcare.co.uk.

Some information may need to be retained after account closure where required for legal, safeguarding, clinical, audit, contractual or regulatory reasons. Further details should be set out in our Privacy Policy.


20. Limitation of Liability

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that, we are not liable for:

  • use of the App contrary      to these Terms; 
  • failure to follow      therapist instructions; 
  • use of therapy      activities for a child for whom they were not recommended; 
  • failure to seek      professional, emergency, safeguarding or clinical help; 
  • inaccurate or      incomplete information provided by users or third parties; 
  • decisions made solely      on the basis of App content or outputs; 
  • third-party services; 
  • service interruptions      or technical failures outside our reasonable control; 
  • indirect or      consequential loss. 

For consumer users, nothing in these Terms affects your statutory rights.

If your concern relates to the child’s therapy, diagnosis, progress, safety, safeguarding or care, you should contact the relevant speech and language therapist, healthcare provider, school, local authority, NHS service or emergency service as appropriate.


22. Changes to These Terms

We may update these Terms from time to time.

Where changes are significant, we will take reasonable steps to notify users, such as by email, in-app notice or requiring acceptance of updated Terms.

The date at the top of these Terms shows when they were last updated.

If you continue using the App after changes take effect, you agree to the updated Terms.


23. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, unless mandatory consumer laws in another UK jurisdiction apply.

The courts of England and Wales will have jurisdiction, except that consumers living in Scotland or Northern Ireland may also bring proceedings in their local courts.
